These Terms of Use (the “Terms”) form a binding agreement between you and the Alternative Propulsion Engineering Conference (“Alt Propulsion,” “we,” “us,” or “our”). If you do not agree, do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization; “you” also refers to that entity.

5) Safety, Experimental Risks & Assumption of Risk
The fields discussed on the Site can involve high-risk activities (e.g., high voltage and current, lasers, cryogens, vacuum systems, pressure vessels, radiation sources, rotating machinery, energetic materials, strong magnetic fields, and airborne contamination risks).
Do not attempt any experiment or build described on the Site without proper training, equipment, safety procedures, supervision, and compliance with applicable laws, codes, and standards.
By using the Services, you acknowledge and voluntarily assume all risks associated with any action you take based on the Site Content, including injury, death, property damage, and legal consequences.

Responsibility. You are solely responsible for your User Content and represent that you have all rights necessary to grant the above license and that your User Content does not violate any law or third-party right.

Publicity. If you participate in recorded video conferences or interviews, you consent to our recording, editing, and publication of your appearance and contributions, subject to any additional presenter/release terms we may provide.
7) Prohibited Conduct
You agree not to:

Infringe intellectual property, privacy, or publicity rights.

Harass, threaten, defame, or engage in hateful, discriminatory, or abusive behavior.

Post or transmit malware, spam, or content designed to disrupt, surveil, or damage.

Misrepresent your identity or affiliation, or impersonate others.

Publish dangerous instructions without adequate, legally compliant safety context or that reasonably appear intended to facilitate illegal activity.

8) Community & Video Conference Code of Conduct
To foster a respectful, inclusive environment for advanced scientific discussion, you agree to the following when participating in AltPropulsion events, forums, chats, and video conferences:

Respectful Communication. Be professional and civil. No personal attacks, insults, or disruptive behavior.

Intellectual Integrity. Engage in evidence-based discussion; be open to critique; avoid knowingly spreading misinformation.

Inclusivity & Non-Discrimination. No harassment or discrimination based on protected characteristics or personal attributes.

Safety & Legality. Do not solicit or instruct illegal acts or unsafe practices.

Privacy. Do not share private or identifying information about others without consent.

Moderation. Organizers and moderators may warn, mute, remove, or ban participants at their discretion for violations.

Reporting. Report concerns using our contact page. We may take any action we deem appropriate, including referral to law enforcement if necessary.
9) Intellectual Property; DMCA

Our Rights. The Services, Site Content, trademarks, logos, and design elements are owned by AltPropulsion or our licensors and are protected by IP laws. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTPROPULSION AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, LICENSORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
16) Indemnification
You agree to indemnify, defend, and hold harmless AltPropulsion and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or applicable law.
17) International Use; Export Controls
You are responsible for compliance with local laws where you access the Services. You agree not to export or re-export any part of the Services in violation of U.S. export control and sanctions laws.
18) Governing Law; Venue; Dispute Resolution
These Terms are governed by the laws of Washington State, USA, without regard to its conflict of laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Whatcom County, Washington for all disputes not subject to arbitration.
Optional Arbitration Clause (replace if desired): Any dispute arising out of or relating to these Terms or the Services shall be finally resolved by binding arbitration administered by a provider of our choosing under its rules, on an individual basis with no class actions, and held in Bellingham, WA. Judgment on the award may be entered in any court of competent jurisdiction.
19) Miscellaneous

Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us concerning the Services.

Severability. If any provision is found unenforceable, the remaining provisions remain in full force and effect.

No Waiver. Our failure to enforce a right or provision is not a waiver of it.
